1. Service provider
The Service is provided by Chessmis (“Chessmis”, “we”, “us” or “our”).

2. Eligibility and minors
2.1 Minimum age
The Service is available to users aged 6 or older. Access by a minor remains subject to the law applicable to that user.
2.3 Responsibility of the parent or guardian
A parent or legal guardian who authorises a minor’s use is responsible for supervising that use, subject to mandatory law. Chessmis may request reasonable evidence of age or authority and may restrict an account where legally required safeguards have not been completed. Chessmis does not currently provide a separate verified-parental-consent workflow.
3. Accounts and security
3.1 Account information
You must provide accurate information, keep it reasonably current and use only an account you are authorised to use. Accounts may be created with email and password or a supported third-party sign-in service.
3.2 Account security
You are responsible for safeguarding access to your account and connected credentials. Notify chessmis.support@gmail.com promptly if you suspect unauthorised access. You must not sell or transfer an account or share it in a manner that compromises security.
4. The Service
4.1 Chess features
Chessmis provides chess-game import from supported sources, PGN processing, engine analysis, training exercises, opening study, learning progress and automated coaching. Availability may vary by account, device, location or development stage.
4.2 Educational purpose
Analysis, evaluations and training material are provided for chess education and general information. They are not guaranteed to be complete, error-free or suitable for every playing situation.
5. User content and chess data
5.1 Your responsibility
You may submit PGN data, chess positions, usernames, requests and other material necessary to use the Service (“User Content”). You represent that you have the rights or other lawful basis required to submit and use it through the Service.
5.2 Limited licence to operate the Service
You retain any rights you hold in User Content. You grant Chessmis a limited, non-exclusive, worldwide licence to reproduce, process, adapt and transmit User Content only as reasonably necessary to provide, secure and maintain the Service, comply with law and enforce these Terms. No licence is granted to train Chessmis-owned models. The licence ends when the relevant content or account is deleted, except where limited continued retention is legally required or occurs in protected backups.
5.3 Third-party game data
Game records and metadata obtained from third-party chess platforms remain subject to applicable rights and platform rules. You must not collect, republish or exploit third-party data unlawfully.
6. Acceptable use
You must not break applicable law or another person’s rights; access another account without permission; introduce malicious code; disrupt or circumvent security; send excessive automated requests; misrepresent submitted content; use assistance during a live game contrary to applicable fair-play rules; or help another person do so.
7. Automated analysis and AI features
7.1 Nature of output
Some features generate engine analysis or artificial-intelligence output. Such output is produced by software, may be inaccurate or incomplete and must be evaluated independently. It is not a statement by a human coach unless expressly identified as such.
7.2 Appropriate use
You must not rely on automated output where an error could create material harm or use it to breach fair-play rules. Specialised service providers may process necessary requests to provide these functions. Personal-data handling is described in the Privacy Policy.
8. Third-party services
The Service may interoperate with third-party authentication, chess, infrastructure, email and automated-analysis services. Those services are governed by their own terms and policies. Chessmis does not control their independent acts, availability or content. References to third-party names do not imply sponsorship or affiliation.
9. Paid Services
9.1 Paid subscriptions
Chessmis offers the paid plans shown on the Pricing page. The plan catalogue states the primary price in US dollars and the current Telegram Stars amount used for payment. Before purchase, the plan, billing period, included features, applicable taxes and renewal terms displayed at checkout form part of these Terms.
9.2 Payment and renewal
If recurring billing is introduced, it will renew only on the basis disclosed at checkout and until cancelled. Material price changes will be disclosed in advance where required by law.
9.3 Cancellation
If recurring billing is introduced, a cancellation method and the contact address chessmis.support@gmail.com will be provided before charging users. Account deletion will not substitute for cancellation unless expressly stated at checkout.
9.4 Withdrawal and refunds
Mandatory consumer rights, including any applicable withdrawal right and mandatory refund, remain unaffected. Required consent for immediate performance will be requested before a Paid Service begins.
10. Intellectual property
10.1 Chessmis materials
The Service, including its software, interface, branding, original lessons, text, graphics and arrangement, is owned by Chessmis or its licensors and protected by applicable law. These Terms grant only a limited, revocable, non-transferable right to use the Service for its intended purpose.
10.2 Feedback
If you voluntarily provide suggestions or feedback, Chessmis may use them without restriction or compensation. This does not grant ownership of personal data or User Content.
11. Suspension and termination
11.1 By you
You may stop using the Service at any time. Account deletion may be initiated in Settings and requires completion through a time-limited confirmation link sent to the verified account email. The deletion flow signs the user out and removes account-linked records described in the Privacy Policy, subject to lawful limited retention.
11.2 By Chessmis
We may reasonably restrict, suspend or terminate access to address a material breach, protect users or the Service, comply with law, prevent fraud or security threats, or discontinue the Service. Where appropriate and legally permitted, we will provide notice and a reasonable opportunity to remedy the breach.
11.3 Effect of termination
Termination ends the right to use the affected account or Service. Provisions that by their nature must continue, including intellectual-property protections, accrued obligations, liability and dispute provisions, survive termination.
12. Availability and changes
We may maintain, update, replace or discontinue features and do not promise uninterrupted availability. Where mandatory law requires notice or a remedy, it remains unaffected. You should retain copies of important PGN data and other material.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. Chessmis does not warrant that every analysis, evaluation, recommendation or third-party integration will be accurate, complete, uninterrupted or error-free. Mandatory warranties and consumer rights remain unaffected.
14. Limitation of liability
14.1 Non-excludable liability
Nothing in these Terms limits liability that cannot lawfully be limited, including applicable liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer remedies.
14.2 Other liability
To the maximum extent permitted by law, Chessmis is not liable for indirect or consequential loss caused by unauthorised account use, a third-party service, breach of fair-play rules, or reliance on automated output contrary to these Terms. Any future limitation applicable to Paid Services will not reduce mandatory rights.
15. Privacy
The Chessmis Privacy Policy explains how personal data is collected, used, disclosed, retained and deleted. It is a separate notice and does not replace these Terms. Privacy Policy: /privacy.
16. Governing law and disputes
16.1 Informal resolution
Before formal proceedings, you may contact chessmis.support@gmail.com to attempt resolution. This does not suspend a mandatory limitation period unless law provides otherwise.
16.2 Applicable law
These Terms are governed by the law applicable to the Service provider, subject to mandatory conflict-of-law and consumer-protection rules. A consumer is not deprived of mandatory protection granted by the law of the consumer’s habitual residence.
16.3 Courts and consumer remedies
Disputes are submitted to the courts having jurisdiction under applicable law. Consumers retain access to courts, authorities and alternative remedies available under mandatory law.
17. Changes to these Terms
We may update these Terms to reflect changes in the Service, law, security requirements or operations. The updated version will state its effective date. Material adverse changes will receive advance notice where required. Fresh acceptance will be requested when legally or contractually necessary; editorial changes do not automatically require renewed acceptance.
18. General provisions
If a provision is unenforceable, it applies to the maximum lawful extent and the remaining provisions continue. Failure to enforce is not a waiver. You may not transfer rights or obligations without our consent except where mandatory law permits. Chessmis may transfer these Terms as part of a genuine reorganisation, financing or transfer of the Service, subject to applicable law and mandatory rights.
